Probate and Estate Litigation
The responsibility of administering the Estate of someone who has died can be time consuming and a little daunting. You may want to hand it over completely to someone you trust, or you may just want advice and support in undertaking these legal responsibilities. However we understand that family relationships can be complex and that there can be concerns about a Will. You may simply have questions to which you want reliable answers in order to put your mind at rest. Alternatively a Will may not be clear as to what beneficiaries are to receive. Sometimes people believe that they have been wrongly left out of a Will or there are concerns over testamentary capacity or claims by spouses and dependents where there was no Will. We can advise and assist you in resolving these types of difficulties by liaising upon your behalf with the parties concerned or alternatively taking or defending litigation in appropriate circumstances.
Alan Thompson is a member of the Charity Law Association and has advised numerous small charities over many years. He is a trustee of an established Sussex charity. He is therefore able to provide professional expertise with the benefit of first hand experience to assist and simply the legal and regulatory framework with which all charities must comply. Estate and Lifetime Planning
It may be that you have a blended family or perhaps you wish to pass your assets on to your grandchildren rather than your children. It may be that you do not have children or simply wish to leave your estate elsewhere. It may be that you are involved in a new “common-law” relationship but still wish to ensure that the majority of your assets pass to your children. In these and other situations, you need to understand the implications of your wishes as well as the best means to ensure they are implemented. Often, there are tax implications that need to be considered as well. We call this Estate Planning. We will assist you to ensure that whatever your circumstances, your wishes for your estate will be carried out appropriately after your death. We will assist with estate deadlocks, trusts and tax planning, charitable donations, guardianship of children, planning for disabled children, as appropriate for your situation. We will provide, as necessary, Pre-Nuptial or Co-Habitation Agreements, Separation Agreements, all in a manner that helps ensure that your assets are protected.
Wills, Advance Decisions, Lasting Powers of Attorney
Taking time out of our busy lives to think about the challenging 'what ifs' can be difficult. Our extensive experience of helping clients, repeatedly shows that by doing something to protect your family in the better times, such as writing your Will or making a Health &/or Financial Lasting Power of Attorney, brings peace of mind in knowing that you have done everything you can to look after those you care about most-whatever the future holds.
We try to make things as straightforward as possible and offer two Fixed Fee Will options starting from around £200. We also offer a Bespoke option for those whose affairs are more complicated or who require advice on trusts or tax planning. All our Will options come with free storage and a free future review.
